More about Leasehold Valuation Tribunal
The Leasehold Valuation Tribunal (LVT)
provides an easy and informal way to resolve residential
leasehold disputes. Leaseholders have the right under law to
ask the LVT to determine the reasonableness of their service
charge.
The LVT can:
- determine the reasonableness of a service charge or an
administration charge and whether it is payable
- determine disputes relating to insurance
- make orders, where appropriate, appointing a manager
- vary residential long leases
- make certain decisions relating to the right to manage
The jurisdiction of LVT is widened
significantly under the Common hold and Leasehold Reform Act 2002
to determine whether or not a service charge is payable and applies
to charges already paid as well as those proposed.
LVT can also:
- consider administration charges and determine
both their reasonableness and any formula in the lease to arrive at
them
- vary leases that did not make adequate
provision to various matters including service and other
charges
- award costs where the proceedings have been
brought frivolously, vexatiously or otherwise unreasonably.
